Abuse Policy
Lavabit has a responsibility to protect its reputation, its users and the Internet from abusive activities. If we discover that you’re in violation of this Abuse Policy we reserve the right, at our sole discretion, to warn, suspend or terminate your account.
By using our services you agree not to:
- Send unsolicited commercial e-mail, including but not limited to messages that violate the CAN-SPAM Act or any other applicable antispam law.
- Advertise your e-mail address in unsolicited commercial e-mail.
- Resell or sublicense the use of your account.
- Use your account to harass or threaten others.
- Make libelous or defamatory statements.
- Infringe the intellectual property rights of another, including but not limited to the copyright, trademark or patent rights of another.
- Use our services to violate the rights, including privacy and publicity rights of another.
- Use our service in the aid of or to promote illegal activities.
- Impersonate someone without that individual’s express consent.
- Intentionally send harmful or destructive files.
- Use our services in such a way that your use prevents access or degrades the performance of our services for other users.
Lavabit does not actively monitor, censor or restrict its users. Lavabit does not claim any responsibility for the actions of its users. However, if presented with evidence that a particular user has violated this Abuse Policy, we will take appropriate action, including but not limited to:
- Locking the user’s account.
- Referring the submitter of the evidence to the FBI’s Internet Crime Complaint Center.
- Surrendering any applicable records to authorities if presented with a properly formed court order.
To report abuse, visit our report abuse page. If your complaint involves e-mail, please be sure to submit the entire message including the message header. If you’re reporting illegal activity, please also submit a copy of, or link to, the police report.
If you believe that your account has been improperly locked, you can dispute our actions. To open a dispute case, use the contact page. Our administrators will evaluate your petition and take appropriate action at their sole discretion.
